Please read these Terms of Service carefully before using the SPARQ application. By downloading, installing, or using SPARQ, you agree to be bound by these terms. If you do not agree, do not use the app.
These Terms of Service ("Terms") constitute a legally binding agreement between you and MK Innovations Group, LLC ("Company," "we," "us," or "our") governing your use of the SPARQ mobile application and any related services (collectively, the "Service").
You must be at least 13 years of age to use SPARQ. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
SPARQ does not currently require account registration. Your session data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored on it related to SPARQ.
SPARQ offers a free tier and a paid subscription plan ("SPARQ Pro"). The following terms apply to all paid subscriptions:
Auto-Renewal Disclosure (Required by Apple & Google)
SPARQ Pro subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage and cancel your subscription at any time in your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access until that date.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a SPARQ Pro subscription.
You agree to use SPARQ only for lawful purposes and in accordance with these Terms. You agree not to:
SPARQ uses Anthropic's Claude AI to generate responses. You acknowledge that:
Your use of AI features is also subject to Anthropic's Usage Policies, available at anthropic.com/policies.
SPARQ, including its name, logo, design, code, and all content created by us, is owned by MK Innovations Group, LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.
Content you input into SPARQ remains yours. By using the AI features, you grant us and Anthropic a limited license to process your inputs solely to provide the Service.
SPARQ is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
To the fullest extent permitted by applicable law, MK Innovations Group, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of SPARQ, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
We reserve the right to suspend or terminate your access to SPARQ at any time for violation of these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, and 11 survive termination.
These Terms are governed by the laws of the United States and the state in which MK Innovations Group, LLC is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may modify these Terms at any time. When we make material changes, we will notify you through the app or via the email associated with your account. Your continued use of SPARQ after changes are posted constitutes your acceptance of the updated Terms.
If you downloaded SPARQ from the Apple App Store, you acknowledge that these Terms are between you and MK Innovations Group, LLC only, and not with Apple Inc. Apple is not responsible for SPARQ or its content. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple terms shall govern solely with respect to your use of the App Store.
If you downloaded SPARQ from Google Play, these Terms are between you and MK Innovations Group, LLC. Google LLC is not a party to these Terms and has no obligation or liability to you with respect to SPARQ.
